Acceptable Use Policy

This AUP governs the use of DataClub's hosting service. Violation of this AUP may result in suspension or termination of your service. In the event of a dispute between you and DataClub regarding the interpretation of this AUP, DataClub's interpretation, in its reasonable commercial judgment, shall govern. Offensive Content

You may not publish or transmit via DataClub's service any content that DataClub reasonably believes:

Content "published or transmitted" via DataClub's service includes Web content, e-mail, bulletin board postings, chat, and any other type of posting or transmission that relies on any Internet service provided by DataClub.

Prohibited Content

Examples of prohibited content or links include (but are not limited to):

DataClub will be the sole arbiter as to what constitutes a violation of this provision. Content that does not meet these standards will be removed without prior notice to the subscriber.

Housing of any of the following files is considered a violation of the terms of service:

IRC - We currently do not allow IRC, Egg Drops, BNC, or IRC bots to be operated on our servers or network. Files with references to IRC or any likeness thereof are prohibited. Also any program that acts like an IRC server or that provide chat functions that run as background processes are not allowed.

Proxies - We do not allow proxy servers of any kind, whether for personal or business use. Files with references to any proxy or likeness thereof are prohibited.

PortScanning - We do not allow any kind of portscanning to be done on or from our servers or network.

Data Backup/Archiving and Storage of Disallowed Material

The customer agrees to make use of our web hosting service for the purpose of hosting websites, and associated email functions. Data uploaded must be primarily for this purpose. DataClub servers are not intended as a data backup or archiving service, including archiving via email. No warez, serialz, cracks, disc images, copyrighted material by third-parties, or any other illegal material is allowed on DataClub servers. DataClub reserves the right to remove all offending data from the servers at any time. In addition, any account that violates this policy, regardless of the number of offending files, calls for immediate de-activation without any refund of payments made thus far.

Security

You must take reasonable security precautions. You must protect the confidentiality of your password, and you should change your password periodically.

Bulk Commercial E-Mail

You must obtain DataClub's advance approval for any bulk commercial e-mail, which will not be given unless you are able to demonstrate all of the following to DataClub's reasonable satisfaction:

These policies apply to messages sent using your DataClub service, or to messages sent from any network by you or any person on your behalf that directly or indirectly refer the recipient to a site hosted via your DataClub service. In addition, you may not use a third party e-mail service that does not practice similar procedures for all its customers.

DataClub may test and otherwise monitor your compliance with its requirements, including requesting opt-in information from a random sample of your list at any time.

Unsolicited E-Mail

You may not send any unsolicited e-mail, either in bulk or individually, to any person who has indicated that they do not wish to receive it.

You must comply with the rules of any other network you access or participate in using your DataClub's services.

Material Protected by Copyright

You may not publish, distribute, or otherwise copy in any manner any music, software, art, or other work protected by copyright law unless: DataClub will terminate the service of repeat copyright infringers.

DataClub is under no duty, and does not by this AUP undertake a duty, to monitor or police our customers' activities and disclaims any responsibility for any misuse of the DataClub network.

Internet Abuse

You may not engage in illegal, abusive, or irresponsible behavior, including:

Newsgroup, Chat Forums, Other Networks

You must comply with the rules and conventions for postings to any bulletin board, chat group or other forum in which you participate, such as IRC and USENET groups including their rules for content and commercial postings. These groups usually prohibit the posting of off-topic commercial messages, or mass postings to multiple forums.

Jurisdiction

DataClub always applies the laws of the United States and the State of California to any legal analysis by our Company. We may also apply the laws of other jurisdictions to a particular website or issue. Customers must submit to personal jurisdiction in California, and agree to file all legal claims in the County of Riverside. This agreement shall be governed in all respects by California law without regard to the conflict of law provisions thereof.
